Gainday is a technology platform that enables employers to recruit using role-specific work simulation assessments. Gainday provides AI-assisted assessment and decision-support technology. It does not make final hiring decisions on behalf of employers.

What Gainday is, and what it is not
Gainday is a technology platform that enables employers to assess candidates through role-specific work simulation assessments. It is not a recruitment agency, an employment agency or an employment business.
Gainday does not employ candidates, does not supply workers, and does not enter into employment contracts with candidates.
Gainday does not guarantee an interview, progression or a job offer to any candidate.
work simulation assessment scoring is AI-assisted decision support that helps employers review submitted work. It never makes the hiring decision.
Employers remain responsible for reviewing candidate evidence and making their own recruitment and hiring decisions.
No solely automated decision with legal or similarly significant effect is made about a candidate. A human always reviews before any hiring outcome.

A4. Candidate information and employer responsibilities
Gainday processes candidate information during the Gainday assessment process. When Gainday provides identifiable candidate information to an employer for recruitment purposes, the employer is responsible for complying with its own data-protection and employment obligations in relation to that information. Employers must:
Process candidate information lawfully
Keep candidate information secure
Use candidate information only for legitimate recruitment purposes
Respect candidates' data-protection rights
Comply with applicable equality and employment law
A5. AI-assisted assessment
Gainday may use AI to assist with analysing role requirements, generating work simulation assessments, checking assessment quality, and assessing candidate responses against Gainday's published framework. AI outputs are decision-support information. Employers remain responsible for reviewing the evidence and making their own recruitment decisions. Employers must not treat a Gainday score as an automatic hiring or rejection decision.
A6. Candidate CVs
Candidate CVs may be available to employers where provided as part of the recruitment process. For the Gainday pilot, CV content is not used as an input to AI candidate scoring or ranking. The assessment score is based on the candidate's work simulation assessment responses against the relevant assessment framework.
A7. Sharing employer information
We may share employer information with service providers that help us operate Gainday, including providers supporting hosting, database services, authentication, AI processing, email, security and customer support. We may also disclose information where legally required. We do not sell employer personal data.
A8. International transfers
Some service providers may process information outside the UK. Where required, Gainday will implement appropriate safeguards for international data transfers in accordance with applicable UK data-protection law.
A9. Retention
We retain employer account information for as long as reasonably necessary to operate the account and meet legal and regulatory obligations. Different retention periods may apply to account information, recruitment records, billing records, communications and security records.
A10. Your rights
You have the right to access, correction, deletion, restriction, objection and portability. Contact hellogainday@gmail.com. You may also complain to the Information Commissioner's Office.
A11. Security
Gainday uses appropriate technical and organisational measures designed to protect employer and candidate information. Access is controlled according to account permissions.
A12. Cookies
Gainday uses necessary cookies and, where applicable, non-essential cookies subject to the appropriate consent requirements.
Part B, Employer Terms and Conditions
B1. Using Gainday
Gainday provides technology that enables employers to create a role, generate a work simulation assessment, invite candidates, receive candidate submissions, review assessment evidence and scores, and decide which candidates to progress. Gainday does not employ candidates or make final recruitment decisions.
B2. Employer account
You confirm that:
You are authorised to represent the organisation
Information supplied about the organisation and role is accurate
You will keep your account secure
You will use Gainday lawfully
B3. Work simulation assessments
Gainday may generate assessments using AI-assisted technology based on the role information you provide. You are responsible for reviewing and approving the assessment before it is published. You should ensure that role requirements and assessment criteria are relevant to the position.
B4. Candidate assessment and hiring decisions
Gainday provides assessment evidence and decision support. You agree that:
You will review candidate evidence appropriately
You will not rely solely on an automated score when making recruitment decisions
You remain responsible for the final hiring decision
You will comply with applicable equality and employment law
You will not use Gainday to discriminate unlawfully
B5. Candidate information
You agree to:
Keep candidate information confidential
Use candidate information only for legitimate recruitment purposes
Protect candidate information against unauthorised access
Comply with applicable data-protection law
Delete or securely dispose of candidate information when it is no longer required
B6. Fees and pilot access
Gainday's intended commercial model includes a single candidate unlock at £49 and a five candidate unlock bundle at £149. However, Gainday may operate selected pilots free of charge. For the current pilot, no payment is required and no payment card details are collected through Gainday. Gainday may introduce paid functionality in the future and will provide appropriate information before charging users.
B7. Candidate contact details
Candidate contact information should only be accessed where permitted through the Gainday recruitment workflow. Employers must not attempt to circumvent Gainday's controls to obtain or use candidate information for unrelated purposes.
B8. Intellectual property
Gainday owns its platform, work simulation assessment technology, assessment framework, scoring methodology, software, Capability Passport technology and related intellectual property. Employers retain ownership of job descriptions and other materials they provide to Gainday, subject to the rights necessary for Gainday to operate the service. Employers must not copy Gainday's technology, reverse engineer the platform, resell Gainday's technology, or reproduce Gainday's proprietary assessment methodology without permission.
B9. Confidentiality
Both parties agree to take reasonable steps to protect confidential information received from the other.
B10. Platform availability
Gainday is an early-stage technology platform and may be updated, modified or temporarily unavailable. We do not guarantee that every candidate identified will be suitable, that every candidate will complete an assessment, that a particular number of candidates will apply, or that an employer will make a successful hire.
B11. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Subject to applicable law, Gainday's liability will be limited to losses reasonably foreseeable from its provision of the platform. Gainday is not responsible for an employer's independent recruitment or employment decisions.
B12. Termination
Either party may terminate the employer's use of Gainday. Following termination, Gainday may retain information where required for legal, security, accounting or dispute-resolution purposes.
B13. Governing law
These Terms are governed by the laws of England and Wales.
